(A) An owner or operator of a vehicle or equipment needed to provide a service or repair to a premises on any portion of Fourth Street designated in this subchapter may apply to the Huntingburg Street Department for a special permit to temporarily operate such vehicle or equipment in violation of this subchapter. Such special permit application shall be made at least 72 hours in advance, except in the event of an emergency or exigent circumstance, on a form provided by the city.
(B) Upon receipt of a completed special permit application, the Street Department Superintendent or his or her designee shall issue a special permit for the operation of the described vehicle and equipment for the dates, times, purposes and in the manner specified in the application, unless in the opinion of the Street Department Superintendent or his or her designee, the application does not demonstrate an adequate necessity or the type of equipment or manner of operation pose an undue risk of damage to the street or public ways.
(C) The denial of a special permit may be appealed to the Board of Public Works and Safety, by delivering written notice of such appeal to the Clerk-Treasurer within five days of the denial of such application. Said appeal shall be heard as soon thereafter as is practical.
