(A) The fine for violation of this chapter shall not exceed $50 for each violation thereof, and each day that the violation continues shall constitute a separate offense. A violation of this chapter may be prosecuted in the Allen Circuit or Superior Court. A person found to be in violation of this chapter shall also be responsible to pay all court costs, reasonable attorney fees, and any other costs or expenses incurred in the prosecution of an enforcement action. If injunctive relief is ordered, a person found to have violated this chapter shall also be responsible for any cost incurred in securing an abatement of the nuisance.
(B) Fines for violations of this chapter shall be deposited in the General Fund of the town.
(C) This chapter may be enforced by the Town Council, the Clerk-Treasurer, or the Allen County Police Department.
