(a) Micro utility trucks may be operated upon the public highways, streets, roads and alleys within the corporate limits of the city under the following conditions.
(1) Micro utility trucks, worksite utility vehicles and golf carts may be operated upon the public highways, streets, roads and alleys within the corporate limits of the city, consistent with the intended use and purpose of such special purpose vehicles, subject to the conditions set forth herein and the Humboldt municipal code. Such special purpose vehicles shall be operated only between sunrise and sunset unless such vehicle is equipped with front and rear lights are required by law for motorcycles. Only three persons per bench seat of any special purpose vehicle shall be allowed. Every person operating a special use vehicle on the public highways, streets, roads and alleys of the city shall be subject to all of the duties applicable to a driver of a vehicle imposed by law.
(2) The person operating a micro utility truck shall be subject to all of the duties applicable to a driver of a motor vehicle imposed by law.
(3) Such micro utility truck is insured in compliance with the requirements of § 200 of the Standard Traffic Ordinance, then in effect, which requires liability insurance and which is expressly made applicable herein to micro utility trucks.
(4) The person operating a micro utility shall have a valid driver’s license.
(5) The micro utility truck shall prominently display a valid permit issued by the city allowing for the operation of that particular micro utility truck within the city limits. Such permit shall be issued by the City Clerk after inspection by the city to ensure that all equipment and insurance requirements of this section are met and upon the payment of a $50 fee. Such permit shall expire one year from the date of issuance. In the event the State of Kansas should require state registration of micro utility trucks, then this subsection (a)(5) shall not be applicable.
(b) Violation of this section shall be deemed an ordinance traffic infraction. Upon conviction of such violation, the penalty imposed shall be in accordance with the penalties imposed for such infractions by the Standard Traffic Ordinance, then in effect.
(c) MICRO UTILITY TRUCK shall mean any motor vehicle which:
(1) Has an overall width of not less than 48 inches;
(2) Has an overall length, including the bumper, of not more than 144 inches;
(3) Has an unladen weight, including fuel and fluids, of more than 1,500 pounds;
(4) Can exceed 40 mph as originally manufactured; and
(5) Is manufactured with a metal cab.
