It is unlawful, and a violation of this code, for any person to enter and remain upon any privately owned parking lot or area adjacent to a commercial building when the commercial entity is not open for the conduct of business, unless:
(a) The person is employed by the business providing the parking lot or area and is in the actual performance of his or her employment; or
(b) The person had the express permission of the owner of the property to enter and remain thereon.
