509.08 MINOR'S CURFEW.
   (a)   Responsibility of Minors. No minor shall be outside the confines of his home site or shall congregate, wander, travel through in an automobile, sit in an automobile, loiter or play upon the streets, highways, public places, unsupervised or unenclosed lands, or other places of amusement or entertainment at the following times:
      (1)   Between the hours of 9:00 p.m. and 6:00 a.m. of the following day in the case of minors under thirteen years of age; or
      (2)   Between the hours of 11:00 p.m. and 6:00 a.m. of the following day in the case of minors under eighteen years of age.
   The hours referred to in this subsection mean the official City time, Eastern Standard Time or Eastern Daylight Saving Time, as the case may be.
   (b)   Responsibility of Parents. No parent, guardian or other person having the care, custody and/or control of a minor under the age of eighteen years shall knowingly permit such minor to violate any of the provisions of subsection (a) hereof.
   (c)   Exceptions. This section shall not apply to minors on an emergency errand or on legitimate business as directed by the parent, guardian or custodian of such minors. This section shall not apply to minors accompanied by their parent, guardian or custodian, or some other person over twenty-one years of age who has been given responsibility for their control and custody by the person legally responsible for the discipline of such minors.
   (d)   Special Functions. Whenever any school, church, lodge or other organization sponsors a function which requires minors in attendance to be in violation of subsection (a) hereof, such organization shall obtain the approval of the Police Chief to have such minors remain to the time when the function will end. All such minors attending such function shall return to their respective homes within one-half hour after such function has ended.

   (e)   Penalty.
      (1)   Whoever violates subsection (b) hereof is guilty of a minor misdemeanor.
      (2)   Minors violating any of the provisions of this section shall be dealt with in accordance with Juvenile Court law and procedure.
