935.04 BACKFLOW PREVENTION AND CROSS CONNECTION DEVICES.
   (a)   There is hereby created and implemented a backflow prevention and cross connection (BFP/CC) device program for the protection of the City water system.
   (b)   The BFP/CC program has been developed in accordance with Ohio Administrative Code Section 3745-95 and provides for the inspection, testing, maintenance and installation of backflow prevention and cross connection devices.
   (c)   Containment devices shall be approved by the Ohio Environmental Protection Agency and be testable and accessible. The type of device (double-check or RPZ) shall be approved by the Service Director or Designee. Backflow device test results shall be forwarded to the Service Director or Designee. It is the water customer's responsibility (not the tester) to submit the test report results to the Service Director or Designee. All tests shall be performed by testers currently certified at the time of the test by the Ohio Department of Commerce.
   (d)   If in the judgment of the Service Director or Designee, an approved backflow prevention device is necessary for the safety of the public water system; the Service Director or Designee will give notice to the water consumer to install such an approved device. The water consumer shall, at his own expense, install such an approved device at a location and in a manner approved by the Service Director or Designee and shall have inspections and tests made of such approved devices upon installation and at least annually thereafter.
   (e)   No person, firm or corporation shall establish or permit to be established or maintain or permit to be maintained any connection whereby a private, auxiliary or emergency water supply other than the regular public water supply of the City may enter the supply or distribution system of said municipality, unless such private, auxiliary or emergency water supply and the method of connection and use of such supply shall have been approved by the Service Director or Designee and by the Ohio Environmental Protection Agency.
   (f)   It shall be the duty of the Service Director or Designee to conduct surveys and investigations at properties served by the public water supply where actual or potential hazards to the public water supply may exist. Such surveys and investigations shall be public record and repeated as often as the Service Director or Designee deem necessary.
   (g)   The Service Director or Designee have the right to enter, at any reasonable time, any property served by a connection to the public water supply or distribution system of the Water Department for the purpose of inspecting the plumbing system or systems thereof.
   (h)   The Service Director or Designee is hereby authorized and directed to discontinue, after reasonable notice to the occupant thereof, the water service to any property wherein any connection in violation of the provisions of this ordinance exists, and to take such other precautionary measures as he deems necessary to eliminate any danger of contamination of the public water supply distribution mains. Water service shall not be restored until the violation or non-compliance has been corrected and/or the hazard potential has been eliminated.
   (i)   The Service Director or Designee shall establish Rules and Regulations to govern the application and oversight of the backflow prevention program.
