(A) Regular on sale 3.2% malt liquor. Regular on sale licenses shall be granted only to drug stores, restaurants, hotels, clubs, bowling centers and establishments used exclusively for the sale of 3.2% malt liquor with the incidental sale of tobacco and soft drinks.
(B) Off sale 3.2% malt liquor. Off sale licenses shall permit the sale of 3.2% malt liquor at retail, in the original package, for consumption off the premises only.
(C) Temporary on sale 3.2% malt liquor. Temporary on sale 3.2% malt liquor licenses may only be issued to bona fide clubs, or charitable religious or non-profit organizations. Each license shall be issued to the applicant only, and shall not be transferable to another holder. Each license shall be issued only for the premises specified in the application or a part thereof, and the licenses may not be transferred to another place without the approval of the City Council. Licenses hereunder shall be issued only to applicants who provide satisfactory proof that the applicant is a bona fide club or charitable, religious or non-profit organization, and who satisfy all other requirements or conditions imposed by City Council resolution. Every license shall be granted subject to the conditions as required in all other city ordinances, or other applicable city or state law. Further, each license issued shall be subject to any other conditions imposed by the City Council resolution in granting the license, including the location of the sales, times and dates, and other reasonable conditions imposed. A temporary on sale license issued pursuant to this division (C) may provide for sale on Sunday.
(D) On sale wine license. Wine licenses may be granted with the approval of the Liquor Control Division of the Minnesota Department of Public Safety to a restaurant having facilities for seating at least 25 guests at one time. A wine license permits the sale of wine of up to 14% alcohol by volume for consumption with the sale of food. A wine license authorizes the sale of wine on all days of the week, unless the City Council restricts the license’s authorization to the sale of wine on all days except Sundays. Every license shall be granted subject to the conditions as required in all other city ordinances, or other applicable city or state law. Further, each license issued shall be subject to any other conditions imposed by the City Council resolution in granting the license, including the location of the sales, times and dates, and other reasonable conditions imposed.
