§ 94.02 UNDERGROUND AND BURIED UTILITY DISTRICT.
   (A)   The county hereby establishes an Underground and Buried Utilities District ("Area") to be in effect commencing on May 1, 2017, and to apply throughout the unincorporated areas of Howard County to all county rights-of-way and previously dedicated utility easements.
   (B)   From and after the effective date of this section, no person, corporation, or utility shall erect or construct within the county's rights-of-way or previously dedicated utility easements, any pole, overhead line, or associated overhead structure used or useful in supplying electric, communication or similar associated services, without first obtaining the written consent and approval of the County Board of Commissioners.
   (C)   Any existing overhead poles, wires, and/or utility transmission lines may remain within the county's rights-of-way or granted utility easements, but may not be replaced or relocated without prior written authorization of the Board of Commissioners.
