(a) The rates which consumers of gas shall pay monthly for gas furnished by the city are set by the Council from time to time.
(b) (1) All bills shall be computed monthly on the first day of each month from meter readings taken between the sixteenth and twentieth of each month. All bills shall be payable when rendered and shall be deemed delinquent if not paid on or before the tenth day of the month. All bills not paid by said delinquency date shall result in a delinquency charge being added to said bill in the amount of 10% of said bill and if said bill has not been paid by the twentieth of each month, the consumer will be mailed a delinquency and termination notice.
(2) The delinquency and termination notice shall provide the consumer a record with the following information:
(A) Amount due;
(B) Consumer’s right to a hearing before the Council; and
(C) Notice that service will be terminate in ten days if the bill remains unpaid.
(c) A request for a hearing by the consumer must be filed with the City Clerk no later than three working days before the date of discontinuance. Such hearing shall be conducted by the City Council or such officer or officers as may be designated by the City Council to conduct such hearing. At such hearing the consumer shall have the right to show cause why gas service shall not be discontinued, and the Council or its designee shall have the authority to enter such orders with regard to payment of the account or discontinuance of service as are in the best interests of the city.
(d) All bills for gas service shall be payable to the office of the City Clerk.
(e) The rates to customers insofar as they apply for gas delivered in excess of 1,000 cubic feet may be changed from time to time without further amendment of this section to reflect the changes in price set by Council from time to time of natural gas by the service provider as delivered to the city.
