§ 7-204 OPEN BURNING.
   It shall be unlawful for any person, firm or corporation to set on fire within the city any rubbish, trash, leaves, grass, paper, lumber, toxic material or any other combustible materials at any time, other than in an approved type of gas fired incinerator constructed in accordance with applicable building codes and which is constructed within or attached to the principal building, and fired from within or outside the principal building. A permit shall be obtained annually from the Fire Chief, or his or her authorized representative, for the use of the incinerator and such permit shall be posted in a conspicuous place adjacent to the incinerator, provided that these restrictions shall not apply to a residential fireplace or to charcoal burners or broilers used in the preparation of food. Provided further, that the Fire Chief, or his or her authorized representative, may authorize burning through the issuance of a burning permit if such burning is conducted under the circumstances and conditions specified by the Fire Department.
