§ 52.03 PRIVATE WASTEWATER DISPOSAL (SEPTIC SYSTEMS).
   (A)   Construction; regulation of private wastewater disposal system.
      (1)   Where a public sanitary is not available under the provisions of § 52.02(A)(1), the sanitary sewer shall be connected to a private wastewater disposal system complying with the provisions of this section.
      (2)   Before commencement of construction of a private wastewater disposal system, the owner(s) shall:
         (a)   Submit the proposed plans for the private wastewater disposal system to SD-DENR for review and approval;
         (b)   Obtain an on-site wastewater disposal permit approved by the City Building Official. The application for such permit shall be made on a form furnished by the city. The applicant shall submit any plans, specifications and other information as are deemed necessary by the Building Official; and
         (c)   A permit and inspection fee of $50 shall be paid to the city upon approval of the application. Where construction of a private wastewater disposal system has commenced without a permit the fee shall be multiplied by a factor of four.
      (3)   A private wastewater disposal system shall not become operational until the installation is completed to the satisfaction of the Building Official.
      (4)   The Building Official shall be allowed to inspect the work at any stage of construction, and, in any event, the applicant for the permit shall notify the Building Official when the work is ready for final inspection, and before any underground portions are covered. The inspection shall be made within two business days from the receipt of notice by the Building Official, exclusive of weekends and holidays.
   (B)   Termination; abandonment of private wastewater disposal system.
      (1)   At such time as a public sewer becomes available to a property served by a private wastewater disposal system the following shall be required:
         (a)   Upon failure of the private wastewater disposal system, or upon demand of the Building Official or Public Works Engineer for public health or safety concerns, direct connection shall be made to the public sewer within 60 days of official notice; and
         (b)   Any septic tanks, cesspools and similar private wastewater disposal facilities shall be cleaned of wastewater and sludge and then either removed or filled with fine sand or other approved material.
      (2)   No statement contained in this chapter shall be construed to interfere with any additional requirements that may be imposed by the city or the state in the interest of public health and safety.
