10-2-7: LOT SPLITS:
Any time that an original tract of land, a lot of a recorded plat, or any other parcel of land is divided or partitioned into not more than two (2) lots, parcels, or sites for the purpose of transfer of ownership or development, the following application process and procedures shall be followed:
   A.   Application: An application for lot split on a form provided by the zoning administrator shall be made and shall contain, at a minimum, the following information:
      1.   Name, address, telephone number of the applicant.
      2.   Legal description of property and proof of ownership or agency.
      3.   Description of existing use.
      4.   Zone.
      5.   Legal description of each lot as created by the lot split.
      6.   Description of proposed use.
      7.   Documentation of the permission of the owner of the parcel to be split.
      8.   Description of proposed lot design including locations of all easements and property boundaries.
      9.   Recorded survey, if required by city engineer.
   B.   Procedure: Prior to approving an application under this section, the city council shall make the following findings:
      1.   The minimum requirements under the city code for acreage, density, lot area and setback have been complied with;
      2.   The proposed lot split is in conformity with the comprehensive plan; and
      3.   The proposed lot split is in the public interest and will not adversely impact adjoining property interests.
   C.   Notice: Within ten (10) days after a decision has been rendered, the council shall provide the applicant with written notice of the action on the request. (Ord. 193, 12-13-2001)
