§ 116.36 TRANSFER OF OWNERSHIP OR CONTROL.
   (A)   Except as provided in HCO Chapter 100, there shall be no voluntary or involuntary transfer without the prior written approval of the City Council. A transfer is any transaction in which:
      (1)   All or a portion of the cable system is sold or assigned voluntarily or involuntarily (except a sale or assignment that results in removal of a particular portion of the facility from the public rights-of-way);
      (2)   There is any change, acquisition or direct or indirect transfer of control of the franchisee; or
      (3)   The rights and/or obligations held by the franchisee under the franchise are transferred, sold, assigned or leased in whole or in part, directly or indirectly, to another party.
   (B)   Applications for approval of transfers shall be filed as provided in HCO Chapter 100. The city will review transfer applications in accordance with the standards set forth in HCO Chapter 100.
