(A) Neither the granting of the franchise nor any provision of the franchise or this chapter shall constitute a waiver or bar to the exercise of any governmental right of power, police power or regulatory power of the city as may exist at the time the franchise was issued or may thereafter be obtained. In accepting the franchise, the franchisee acknowledges its rights hereunder are subject to the police and other rights and powers of the city.
(B) Any conflict between the provisions of this chapter and any other present or future lawful exercise of the city's rights and powers shall be resolved in favor of the city.
