§ 116.02 DEFINITIONS.
   For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meaning given herein. When not defined herein, the terms, phrases, words and their derivations shall have the meaning prescribed in HCO Chapter 100 or, if not specifically defined therein, shall be construed in accordance with that chapter.
   CABLE MILE. A linear mile of strand-bearing cable as measured on the street or easement from pole to pole or pedestal to pedestal.
   CABLE SYSTEM or SYSTEM. The same definition as herein.
   CONVERTER. An electronic device which converts signals to a frequency not susceptible to interference within the television receiver of a subscriber and, by use of an appropriate channel selector, also permits a subscriber to receive all signals delivered at designated converter dial locations.
   COUNCIL. The governing body of the City of Hopkinsville.
   FRANCHISE AREA. A geographic area within the city, which is not currently served by a cable provider and is less than 70 contiguous acres.
   FRANCHISEE. Any entity and its permitted successors, transferees or assigns providing cable television service within an area limited to less than 70 contiguous acres within the corporate limits of the City of Hopkinsville.
   GROSS REVENUES. The meaning set forth herein.
   INSTALLATION. The connection of the cable system from feeder cable to subscribers' terminals.
   MONITORING. Observing a communications signal, or the absence of a signal, where the observer is neither the subscriber nor the programmer, whether the signal is observed by visual or electronic means for any purpose whatsoever. This is provided, MONITORING shall not include system wide, nonindividually addressed sweeps of the cable system for purposes of verifying system integrity, controlling return path transmissions or billing for services.
   SALE. Any sale, exchange, barter or offer for sale.
   STATE. The State of Kentucky or any body delegated authority by the state.
