§ 115.03 RECORD KEEPING BY PRECIOUS METALS DEALERS.
   (A)   Each precious metals dealer shall keep a daily register of all purchases of all articles effected or made by him or her and shall at all times be open to inspection by any officer of the Hopkinsville Police Department when in the discharge of the officer’s official duties. The registry shall include all information listed in divisions (C), (D) and (E) below.
   (B)   In addition to the registry required by division (A) above, every dealer shall create and maintain an account with the Hopkinsville Police Department and make daily reports in an electronic database registry designated by the Police Chief and enter a record of all purchases of all property effected or made. In the event a precious metals dealer becomes unable to enter purchases in the Hopkinsville Police Department’s database because of computer or other technical problems, the precious metals dealer shall bring the register of sales, purchases and loans to the Hopkinsville Police Department daily until the ability to enter all loans and purchases is restored.
   (C)   The following must be noted concerning the transaction:
      (1)   Date;
      (2)   Time; and
      (3)   Disposition of the item, including name and address of purchaser.
   (D)   The following record must be kept relating to the articles purchased; the description of the item shall include:
      (1)   Manufacturer’s name;
      (2)   Serial number, if any;
      (3)   Any distinguishing marks;
      (4)   Pattern;
      (5)   Number of items; and
      (6)   Photograph of item.
   (E)   The following records must be kept relating to the seller:
      (1)   Name;
      (2)   Address;
      (3)   Date of birth;
      (4)   Age;
      (5)   Hair color;
      (6)   Race;
      (7)   Sex;
      (8)   Height;
      (9)   Weight;
      (10)   Two identification cards, one of which must be a valid photo identification issued by any governmental agency for purposes of identifying the holder.
   (F)   There is specifically excepted from the terms of this chapter any transaction by a person engaged in business within the city, possessing a current business license from the city, who is either accepting returns for cash, credit or replacement of any item for another item of greater value. In addition, the terms of this chapter shall not include any purchase by a retailer from a bona fide manufacturer, nor any banking institution licensed to do business in the state.
