§ 114.07 REGISTRATION DISQUALIFIERS; APPEAL FROM DECISIONS OF CHIEF FINANCIAL OFFICER.
   (A)   Within three working days of receipt of the registration, the Chief Financial Officer shall either issue a solicitation permit or notify the solicitor the registration does not comply with requirements of this chapter and specifically identify what information or explanation has not been furnished.
   (B)   Within two working days of receipt of written information or explanation not previously furnished by the solicitor, the Chief Financial Officer shall issue the solicitation permit, unless the Officer determines:
      (1)   Any statement made in the registration is untrue, false, misleading, incomplete or factually incorrect; and/or
      (2)   The solicitor or the principal officers of the organization submitting the registration have been previously convicted of violating the provisions of this chapter, or convicted of violating similar statutes or ordinances enacted by other jurisdictions to regulate the door-to-door solicitations, or convicted of a felony within ten years next preceding the date of registration or has been convicted of any crime involving fraud or theft by deception in the last five years, or convicted of any sex crime or violent crime as specified in KRS 17.165.
   (C)   In the event the Chief Financial Officer makes a finding as to disqualification for a permit, the Officer shall give written notice to the solicitor by certified mail. The notice shall state the deficiency found in the registration and that the registration is denied.
   (D)   In the event a registration is denied for any reason, the solicitor may request a hearing before the Chief Financial Officer, by filing with the Officer within two working days of receipt of the Officer's denial a written request that the Officer reconsider the denial. The request shall set forth with specificity the reasons for the request. The Chief Financial Officer shall conduct a hearing within five business days of the date of receipt of the solicitor's request, unless the solicitor requests an extension and agrees, in writing, not to conduct any solicitation activity during the period prior to the hearing. The solicitor may be present in person or by representative and shall be entitled to legal counsel. Additionally, the solicitor shall be entitled to introduce evidence on his or her behalf and correct any identified errors or omissions in the registration. The Chief Financial Officer shall issue a decision within two working days after the hearing.
   (E)   In the event the Chief Financial Officer issues a decision adverse to the solicitor, the solicitor may appeal to the Christian Circuit Court within 30 days after the denial.
