§ 114.03 REGISTRATION REQUIREMENTS.
   (A)   Registration. All natural persons desiring to engage in soliciting at residences in the City of Hopkinsville, Kentucky, thereof shall apply for an annual permit on a registration form provided by the City of Hopkinsville. The solicitor for the permit shall state, upon his or her oath or affirmation, the information is truthfully provided to the best of his or her knowledge and belief. The registration along with a $25 registration fee must be returned to the Chief Financial Officer's office. The solicitor shall supply upon the form the following information:
      (1)   Solicitor's true, correct and legal name, including the name and address of any entity by which the solicitor may be employed in sales or for whose benefit solicitor will be soliciting;
      (2)   Address of solicitor's permanent home and address of any temporary local residence;
      (3)   The purpose for which soliciting will be done;
      (4)   A brief description of the method of presentation that will be made (such as presentation of samples and taking of written orders);
      (5)   The dates for when soliciting is planned; and
      (6)   If a permit in connection with soliciting has ever been revoked and the explanation of the circumstances.
   (B)   Non-endorsement. In addition, the solicitor shall certify on the registration if his or her permit is granted, he or she will not state, imply or represent to any person the issuance of the permit is an endorsement by the City of Hopkinsville, Kentucky, nor any of its agencies or departments of the product, service or solicitor.
   (C)   Proof of identification required. For each solicitor, the registration shall be accompanied by a copy of one of the following:
      (1)   A valid drivers license of any state if solicitor possesses such and intends to operate a motor vehicle in the jurisdiction;
      (2)   A valid United States Uniform Service Identification;
      (3)   A valid passport; or
      (4)   A valid identification issued by any agency of a state for the purpose of identification of the holder.
   (D)   Permit. Permits shall be issued in the form of a photo identification card for each registered solicitor and shall be worn in plain site by each registered solicitor while transacting his or her business or seeking to transact his or her business at any residence. The $25 registration fee includes two permits. Each additional permit issued under the same registration will be an additional $10. In the event a registered solicitor misplaces his or her permit, a replacement will be issued at a cost of $10. The Chief Financial Officer shall maintain copies of all permits.
   (E)   Form of permit. Each permit shall be numbered, list the name of the individual solicitor and of any organization on whose behalf he or she is authorized to solicit (including self if an independent contractor), include a digital photo taken by the Chief Financial Officer's office, contain the date on which the permit expires and be dated and signed by the Chief Financial Officer.
   (F)   Registration complete with issuance. Registration shall be complete when the Chief Financial Officer issues the permit, which shall not be unreasonably withheld or delayed, the period not to exceed three business days.
   (G)   Maintenance of registry. The Chief Financial Officer's office shall maintain for public inspection a record of every registration received and acted upon, together with any information pertaining thereto, all permits and all denials of registrations. Each registration shall be numbered in consecutive order as filed, and each permit issued shall be assigned a number exclusive to the registrant, with a unique identifier for each solicitor. Every permit renewed shall be identified with the duplicate number of the registration upon which it was initially issued. The Chief Financial Officer shall furnish to the Police Chief a list of all permits issued and renewed and the Police Chief shall maintain the listing for public inspection and for identification.
   (H)   Renewal. Permits shall be valid for the calendar year in which they were issued and shall expire at midnight on December 31 of the year. Any permit in good standing may be renewed upon request of the registrant and upon payment of $25. The registrant shall be required to fill out a renewal registration providing the information in the initial registration and each registered solicitor shall be required to come to the Chief Financial Officer's office to renew his or her photo identification card.
   (I)   Nontransferability. Permits shall be issued only in the name of the registrant and the firm, corporation or association on whose behalf he or she is authorized to solicit (self if an independent contractor). Permits shall be nontransferable from individual to individual, from individual to firm, from firm to firm and from firm to individual. It shall be a violation for a solicitor whose permit authorizes soliciting on behalf of a firm named in the permit to solicit on behalf of any other firm, organization or association or for any purpose other than that specified on the registration.
   (J)   General licenses. Issuance of a permit does not waive the requirement for registrant to purchase a license as required in Chapter 110 (General Licensing Provisions) of the Hopkinsville Code of Ordinances.
