§ 94.05 SMOKING IN CITY-OWNED BUILDINGS.
   (A)   (1)   This section is hereby established to prohibit indoor smoking in any city office building, workplace or facility owned and operated by the City of Hopkinsville, as permitted under KRS 61.165, as amended by the 2006 Kentucky General Assembly.
      (2)   The City Administrative Officer is directed to post those buildings affected by this prohibition with the appropriate signage and to remove all internal ashtrays from the facilities. External ashtrays shall be positioned so smoking products can be extinguished appropriately prior to entering the building.
      (3)   Smoking outside the building is regulated only to the extent the activity shall not take place so close to the building so smoke may be drawn into the facility when doors or windows are opened or in the proximity of the air intakes for heating and cooling systems.
   (B)   Any officer or employee of the city who violates this section shall be subject to disciplinary action as specified in the adopted personnel policies. Any other person who violates this section shall be expelled or removed from the premises by the Hopkinsville Police Department or Hopkinsville Fire Department at the direction of the Mayor or City Administrative Officer.
