Pedestrians approaching vehicles or being upon median, prohibited.
(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ARTERIAL ROADWAY. Any arterial roadways listed in division (D)(1) of this section.
(B) Prohibitions.
(1) No person shall cross an arterial roadway at any place except in a crosswalk. Where there is no crosswalk, a person shall cross only at an intersection in which traffic control signals or other devices are in place. Where there is no crosswalk nor traffic control signals or devices, a person shall cross an arterial roadway only at an intersection.
(2) No person, other than a person in or on a vehicle, shall be upon an arterial roadway or, while upon an arterial roadway, approach a vehicle, except one that is legally parked at the curb or shoulder.
(3) No person shall be upon a median of an arterial roadway unless in the process of legally crossing the roadway in a crosswalk. It is prima facie evidence of a violation of this division if a person stays on the median through two consecutive opportunities to cross the roadway in a legal manner under this section and the traffic laws of the Commonwealth of Kentucky. The exception found in division (C)(1) shall not apply to those pedestrians who stay on the median through two consecutive opportunities to cross.
(C) Exceptions. Divisions (B)(2) and (B)(3) of this section shall not apply to:
(1) Any person legally crossing the roadway;
(2) Any person engaged in law enforcement or rescue activities, including providing assistance to an injured or disabled vehicle or person;
(3) Any person entering a stopped vehicle as an invited passenger where it is lawful to do so, including accessing taxicabs or public transportation;
(4) Any person engaged in emergency repair or maintenance activities of a vehicle; and
(5) Any person walking along and upon a highway without a sidewalk and/or shoulder in compliance with KRS 189.570, so long as said person does not approach a vehicle.
(D) (1) The following roadways, which carry the most traffic within Hopkinsville, Christian County, are arterial roadways for the purpose of this section.

(2) This section shall also apply to the first 300 feet of any roadway that intersects with an arterial roadway, as measured from the point where the roadway and the arterial roadway intersect.
(E) Penalty. The provisions of this section may be enforced by the Code of Ordinance Enforcement Board, or in the alternative, the Christian County District Court. Any person violating any of the provisions of this section shall be charged with a misdemeanor and/or violation in the event this chapter is enforced through the Christian County District Court. If charged and enforced through the Code of Ordinance Enforcement Board, the offense shall be a civil offense. A first offense shall result in a fine of no more than $100. A second offense shall result in a fine of no more than $200. All other offenses shall result in a fine of no more than $300.
