(A) Authorization of citation officers. Pursuant to KRS 83A.087, City Council hereby authorizes the designation of citation officers whose duties, functions, responsibilities and roles are subject to the provisions of this chapter and Kentucky Revised Statutes. The designation of citation officer is an additional duty assigned to existing personnel and not a separate job position. Citation officers shall report directly to the Mayor or the Mayor’s designee.
(B) Appointment of citation officers. The appointment of citation officers will consist of the following process:
(1) Citation officers will be appointed by municipal order;
(2) Those individuals appointed as citation officers shall have the responsibility to enforce ordinances as designated in this chapter establishing the Code of Ordinance Enforcement Board and setting forth the ordinances under the Board’s jurisdiction;
(3) Citation officers shall carry identification which identifies them as a citation officer for the City of Hopkinsville; and
(4) Citation officers will immediately notify the public of their position when enforcing a city ordinance.
(C) Powers of citation officers. Individuals designated as citation officers shall be authorized to issue notices of violation and citations pursuant to the Hopkinsville Code of Ordinances and relative Kentucky Revised Statutes. Further, citation officers shall have the authority outlined in § 33.186. Citation officers shall not have the powers of peace officers to make arrests or to carry deadly weapons.
(D) Qualifications of citation officers.
(1) In addition to the minimum requirements set forth by the employer, namely the City of Hopkinsville citation officers must meet the minimum requirements as set forth below:
(a) Be 21 years of age or older;
(b) Possess a valid driver’s license; and
(c) Have no felony conviction.
(2) The designation as citation officer is revoked automatically by the following actions:
(a) By municipal order;
(b) Loss of employment with the City of Hopkinsville;
(c) Loss of a valid driver’s license; or
(d) Any felony conviction after appointment as a citation officer.
(E) Training and development. Citation officers will receive training in, but not limited to, the following areas:
(1) Procedural due process;
(2) Evidence and testimony; and
(3) Case development and presentation.
