§ 51.002 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AIR GAP. A physical separation designed to prevent backflow. The minimum distance of a water inlet or opening above the maximum high water level or overflow level in a fixture, device or container to which public water is supplied. Physically defined as twice the diameter of the supply side pipe, but never less than one inch and need not be more than 12 inches.
   APPROVED. Accepted by the General Manager as meeting an applicable specification stated or cited in this ordinance or as suitable for the proposed use.
   APPURTENANCE. Any component of a water distribution system, including, but not limited to, valves, valve vaults, fire hydrants, meters, meter vaults, water storage tanks, rechlorination stations, booster stations, water salespersons and the like.
   AUTHORIZED REPRESENTATIVE. An authorized representative of the Commission may be any person designated by the Commission to act on its behalf.
   AUXILIARY WATER SOURCE. Any water supply on the premises other than the municipal water system. May include water from the municipal water system which has been in any way treated, processed or exposed to any possible contaminant, or stored in other than an approved storage facility; also referred to as a SECONDARY WATER SOURCE.
   AVAILABLE. As used in connection with this subchapter, means a public water main located on the property line or within 500 feet of the property line, at which point a connection can be made for a building water service line.
   BACKFLOW. The flow of water or other liquids, mixtures, gases or substances into the municipal water system from any source other than its intended source. Includes back siphonage.
   BACKFLOW PREVENTER. Device or means designed to prevent backflow. Commonly categorized as air gap, reduced pressure principle device, double check valve assembly, vacuum breaker, antisiphon pressure breaker, among others.
   BUILDING WATER SERVICE LINE. The extension from a building to the meter; also referred to as the HOUSE CONNECTION.
   CITY. The City of Hopkinsville, Kentucky, its Sewerage and Water Works Commission or other entity having responsibility for the municipal water system.
   COMMISSION. The Commission is the Sewerage and Water Works Commission dba Hopkinsville Water Environment Authority (HWEA).
   CROSS CONNECTION. Any actual or potential connection between the municipal water system and a source of contamination.
   DOMESTIC USE. The ordinary use of water for routine household purposes such as drinking, food preparation, bathing, washing vehicles and intermittent and temporary watering of lawns and gardens.
   EASEMENT. An acquired legal right for specific use of land owned by others.
   ENVIRONMENTAL PROTECTION AGENCY. The U.S. Environmental Protection Agency or, where appropriate, the term may also be used as a designation for the Administrator or other duly authorized official of that agency.
   EQUIPMENT. All moveable, nonfixed items necessary to the water treatment and distribution process.
   GENERAL MANAGER. The person employed by the Sewerage and Water Works Commission as General Manager and in charge of the entire municipal water and sewer system or his or her authorized deputy, agent or representative.
   MUNICIPAL WATER SYSTEM. All facilities for treating, distributing and transporting potable water to the City of Hopkinsville, Kentucky, which is recognized as the public water supply by the Kentucky Department for Environmental Protection, Division of Water.
   OPERATION AND MAINTENANCE. All annual operation and maintenance expenses including replacement related directly to operating and maintaining the water system as shown by the annual audit.
   PERSON. Any individual, partnership, co-partnership, firm, company, corporation, association, joint stock company, trust, estate, governmental entity or any other legal representatives, agents or assigns. Where indicated by the text, the masculine gender shall include the feminine and the singular shall include the plural.
   PREMISES. Any and all areas of a customer's property which are served, or have the potential to be served, by the municipal water system.
   PUBLIC WATER MAIN. A common water main controlled by the Sewerage and Water Works Commission. In general, the PUBLIC WATER MAIN includes the water main in the street or easement and the service branch to the meter; also referred to as a WATER MAIN.
   SPECIFICATIONS. The Commission's specifications for water and waste water design, construction and inspection, latest revision.
   STANDARDS MANUAL. The Commission's Standard Specifications and Details for Water and Wastewater Design, Construction and Inspection, latest revision.
   STATE. The Commonwealth of Kentucky, the Cabinet for Natural Resources and Environmental Protection and the Division of Water.
   STRAPPING. The removal and substitution of a water meter with a length of pipe, tubing or other device.
   SUBMERGED INLET. A water pipe or extension from the municipal water system terminating in a tank, vessel, fixture or appliance which may contain water of questionable quality, waste or other contaminant, and which is unprotected against backflow.
   USER. Any person using water for any purpose from the municipal water system and for which either a regular charge is made, or in the case of bulk sales, a cash charge is made at the time of delivery; also referred to as a CUSTOMER or a CONSUMER.
