(A) This subchapter sets forth uniform requirements for the direct and indirect use of the water system for the City of Hopkinsville, Kentucky, and enables the Sewerage and Water Works Commission to comply fully with all applicable state and federal laws including the Safe Drinking Water Act and its amendments.
(B) The objectives of this subchapter are:
(1) To permit the lawful and acceptable use of the municipal water system for domestic consumption, industrial process, commercial use, construction, agricultural use, irrigation, landscaping and fire protection;
(2) To prevent the contamination of the municipal water treatment and distribution system through the introduction intentionally and unintentionally of pollutants, including chemical, biological and radiological;
(3) To protect the municipal water system from misuse, destructive acts, abuse and vandalism;
(4) To promote efficient and effective use of the treated water by the customers of the municipal water treatment and distribution system; and
(5) To provide for the equitable distribution of the municipal water system cost.
(C) This subchapter provides for the regulation of direct and indirect use of the municipal water system through the issuance of permits, in the form of water meters, to all users and through the enforcement of water use rules, including monitoring of use and consumption of water, and to provide for the setting of fees for the equitable distribution of costs resulting from the program established herein.
(D) This subchapter shall apply to the city and to persons outside the city who are, by contract or agreement with the Commission, users of the city's municipal water treatment and distribution system. Except as otherwise provided herein, the General Manager of the municipal water system shall administer, implement and enforce the provisions of this chapter.
