§ 157.09 ELIGIBILITY FOR RESIDENTIAL ENTERPRISE ZONE INCENTIVES.
   (A)   Developments which contain single-family attached or detached subdivisions, containing five lots or more and found within the designated Residential Enterprise Zone boundaries, are eligible for Residential Enterprise Zone incentives.
      (1)   The single-family attached dwelling units must be on separate lots of record, and the homes must be sold individually.
      (2)   Duplexes, condominiums, multi-family developments, and/or final plats containing four lots or less are not eligible for Residential Enterprise Zone incentives.
   (B)   The owner/developer will be required to meet with Community and Development Services prior to submittal of the preliminary plat in order to make their intent known to apply for Residential Enterprise Zone incentives and receive appropriate application forms.
   (C)   Development found within the inner-city neighborhoods, as indicated on the attached map, of the Residential Enterprise Zone are eligible for incentives for any development of one lot or more.
   (D)   Developments which receive final plat approval after January 1, 2011 are eligible for Residential Enterprise Zone benefits. All developments which have received final plat approval prior to January 1, 2011 are ineligible for Residential Enterprise Zone Benefits.
   (E)   Developments which are continuations of prior developments which have not received preliminary plat approval are eligible for Residential Enterprise Zone incentives as long as they meet the requirements as outlined in this chapter.
   (F)   Any question regarding the eligibility or implementation will be determined by Community and Development Services through the conditions and agreements made during the final plat approval process.
