§ 57.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AUTHORIZED REPRESENTATIVE. An authorized representative of the Commission may be any person designated by the Commission to act on its behalf.
   AVAILABLE. As used in connection with this chapter, means a natural gas main located on the property line or within 500 feet of the property line, at which point a connection can be made for a building gas service line.
   BASE RATE. The base rate includes costs necessary to provide the service, less the cost of gas.
   BUILDING GAS SERVICE LINE. The extension from a building to the meter; also referred to as the HOUSE CONNECTION.
   CCF. One hundred cubic feet.
   CITY. The City of Hopkinsville, Kentucky, its Sewerage and Water Works Commission, or other entity having responsibility for the natural gas system.
   COMMERCIAL CUSTOMER. Multi- family apartment buildings served by one meter and non-residential, non-industrial businesses which include large farm enterprises, all retail stores, restaurants, office buildings and other private business and service establishments.
   COMMISSION. The Commission is the Sewerage and Water Works Commission, dba Hopkinsville Water Environment Authority (HWEA).
   COST OF GAS. Defined in § 57.10. Includes cost of commodity, transport fees, storage fees, balancing fees and taxes.
   COST OF SERVICE. The cost of service shall include the pass through adjustment rate which includes the cost of gas, the base rate, and any applicable fees, penalties, or taxes.
   CURTAILMENT. Reduction or temporary suspension of service due to the limit of transmission capability.
   EASEMENT. An acquired legal right for specific use of land owned by others.
   EQUIPMENT. All moveable, non-fixed items necessary to the natural gas distribution process.
   FEES. Charges which may include meter, service and/or connection fees which are necessary in order to provide the service requested.
   FIRM. Service, either sales or transport, which is not subject to curtailment or interruption except under events of force majeure.
   GENERAL MANAGER. The person employed by the Commission as General Manager and in charge of the entire municipal water and natural gas system or his or her authorized deputy, agent, or representative.
   INDUSTRIAL CUSTOMER. Manufacturing and processing establishments.
   INTERRUPTIBLE. Service, either sales or transport, which is subject to curtailment at any time.
   OPERATION AND MAINTENANCE. All annual operation and maintenance expenses including replacement related directly to operating and maintaining the natural gas system as shown by the annual audit.
   PERSON. Any individual, partnership, co-partnership, firm, company, corporation, association, joint stock, company, trust, estate, governmental entity, or any other legal representatives, agents, or assign. Where indicated by the text, the masculine gender shall include the feminine and the singular shall include the plural.
   PREMISES. Any and all areas of a customer's property which are served, or have the potential to be served, by the municipal gas system.
   RESIDENTIAL CUSTOMER. One- and two-family structures used for domestic dwelling purposes only.
   SALES SERVICE/CUSTOMER. A natural gas customer who exclusively depends on the Commission to procure commodity, transport and delivery of natural gas to the customers meter. The customer has no role in the business transaction between the supplier and the Commission, other than abiding by the terms and conditions for service.
   SIGNIFICANT USER. A customer which uses a minimum of 10,000 CCF per month or an annual amount of 120,000 CCF of natural gas.
   TRANSPORTATION. Transportation service, either interruptible or firm, may be offered by the Commission, if available from its supplier and if the Commission elects to provide the service. The service is for large consumers of natural gas who wish to purchase their own commodity and pay the Commission transport over the Commission's pipeline in order to deliver the commodity the customer purchased, to the customer's meter.
   USER. Any person using natural gas for any purpose for which either a regular charge is made, or in the case of bulk sales, a cash charge is made at the time of delivery; also referred to as a CUSTOMER or a CONSUMER.
