§ 162.05 FLOW CHART OF PROCESS.
   (A)   Step 1. A developer/owner who installs a public improvement covered by this chapter shall notify Community and Development Services during the discussion of the proposed project as specified in the Hopkinsville Subdivision Regulations.
   (B)   Step 2. The developer/owner shall state upon submittal of his or her preliminary plat that the development will contain a public improvement which will require special maintenance measures and provide drafts of all pertinent instruments required by this chapter.
   (C)   Step 3. Community and Development Services will review the material and notify the responsible parties to determine if the maintenance instrument submitted by the developer/owner meet the requirements of the chapter.
   (D)   Step 4. The review undertaken by Community and Development Services shall be conducted as part of the preliminary plat review process.
   (E)   Step 5. Community and Development Services shall approve the public improvement maintenance instruments along with the preliminary plat. The Planning Commission or other regulatory agency may place conditions or require changes in the public improvement maintenance instruments to be addressed during final plat submittal.
   (F)   Step 6. The developer/owner will submit the corrected public improvement maintenance instruments with the final plat.
   (G)   Step 7. Community and Development Services shall review the final plat and maintenance documents simultaneously and take the required actions, i.e., approve, disapprove or approve with conditions or changes.
   (H)   Step 8. The developer/owner will be responsible to see that the public improvement maintenance instruments and other items to be addressed will be submitted, recorded or measures taken to ensure compliance prior to the signing of the final plat.
   (I)   Step 9. Community and Development Services will require that the public improvements be included in the amount of the surety instruments. The developer/owner will provide cost estimates for the installation of the improvements.
   (J)   Step 10. Community and Development Services will have the right to declare the developer/owner in default and claim the surety instrument to install the public improvements.
   (K)   Step 11. Community and Development Services will also have the right to cause the issuance of a citation for noncompliance in conformance with the penalty section of this chapter.
