§ 162.03 APPLICABILITY.
   (A)   This chapter shall apply to any residential and commercial development which incorporates the below list of public facilities either by a requirement of another city ordinance or by choice of the developer.
   (B)   The public facilities which are subject to the regulations and procedures of this chapter are:
      (1)   Decorative street lights;
      (2)   Decorative street signs;
      (3)   Medians; and
      (4)   Decorative pavement textures.
   (C)   Residential and commercial subdivisions which contain the above referenced public facilities must comply with the regulations and procedures set forth herein to be accepted by the city for perpetual maintenance. Public improvements referenced above not installed according to the regulations and procedures will be the responsibility of the developer/owner or other entity or organization and will not be the responsibility of the city to maintain.
   (D)   Supplemental lighting request shall follow the Street Light Policy and Procedure adopted by Municipal Order 14-2011.
