§ 162.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CITY. City of Hopkinsville, Kentucky, a political subdivision of the State of Kentucky.
   COMMERCIAL SUBDIVISION. A division of property into two or more parcels or tracts for commercial activity.
   COMMUNITY AND DEVELOPMENT SERVICES (CDS). The Hopkinsville-Christian County Planning Commission doing business as Community and Development Services.
   DECORATIVE PAVEMENT TEXTURE. A pavement texture which has not been approved by the city or set forth in the Hopkinsville Public Improvement Specifications.
   DECORATIVE STREET LIGHTS. A lighting system consisting of a base, pole and light fixture which is not a standard fixture as provided for by this chapter.
   DECORATIVE STREET SIGNS. A street sign that is not a standard signage entity as constructed by the city as provided for in this chapter.
   LED. Light emitting diode solid state lighting source.
   MAINTENANCE. The act of preserving or retaining a structure or entity in the original condition or form. To keep or repair.
      (1)   ACTIVE MAINTENANCE. For the purpose of this chapter, ACTIVE MAINTENANCE is the responsibility of the City of Hopkinsville to perform by undertaking activities not defined as passive maintenance, but includes the repair or replacement of integral parts of a facility or facilities to ensure proper working order.
      (2)   PASSIVE MAINTENANCE. For the purposes of this chapter, PASSIVE MAINTENANCE is the responsibility of the homeowner and/or lot owner to perform by undertaking routine actions normally associated with yard or property upkeep. Examples such as mowing, trimming, erosion prevention and sowing of grass.
   MEDIAN. A structure or entity which separates traffic lanes and is usually found within a city’s right-of-way. A MEDIAN is normally associated with aesthetic value and has no value for vehicular movement, other than the separation of lanes.
   RESIDENTIAL SUBDIVISION. A division of property into two or more parcels or tracts for residential activity.
   SURETY INSTRUMENT. A form of security including a cost deposit, surety bond, collateral, property or instrument of credit in an amount and form satisfactory to Community and Development Services, to cover the cost of the installation of the public improvement.
