§ 100.38 FRANCHISE OR LICENSE FEE.
   (A)   Amount of franchise fee. Subject to the exception in § 100.39(F), a franchisee shall pay to the city a franchise fee in an amount equal to 3% of its annual gross revenues and every franchise shall reserve the right to increase this fee to the maximum that may be charged consistent with state and federal law.
   (B)   Amount of license fee. Subject to the exception in § 100.39(F), a licensee shall pay to the city a license fee that recovers an amount equivalent to the fair market value of the property used in the city. No license may be issued without an enforceable fee.
