§ 99.99 PENALTY.
   (A)   Administration. The responsibility for the administration of this chapter shall rest with the Planning Commission and any other regulatory agency, department or utility agency which is responsible for the maintenance and operation of the public improvement installed.
   (B)   Enforcement. The provisions of this chapter may be enforced by the Code of Ordinance Enforcement Board established in Chapter 33 of the Hopkinsville Code of Ordinances or in the alternative, the Christian District Court as a misdemeanor and/or violation. The decision on where the ordinance will be enforced shall be at the city’s discretion.
   (C)   Penalty. Any person violating any provisions of this chapter shall be charged with a misdemeanor and/or violation in the event this chapter is enforced through the Christian District Court. If charged and enforced through the Code of Ordinance Enforcement Board, the offense shall be a civil offense. A first offense under this chapter shall result in a fine of not greater than $300. A second offense shall result in a fine of not greater than $400. All other offenses shall result in a fine of not greater than $500. Each day that a violation continues shall constitute a separate offense.
