§ 153.24 BASE FLOOD ELEVATION; FLOODPROOFING.
   (A)   Base flood elevation data. The responsible person shall require that all subdivision proposals and other proposed new developments greater than 50 lots or five acres, whichever is the lesser, include within the proposals base flood elevation data.

   (B)   Elevation; floodproofing of lowest floor. The responsible person shall obtain, review, and reasonably utilize any base flood elevation data available from a federal, state, or other source, until the other data has been provided by the Administrator, as criteria for requiring that:
      (1)   All new construction and substantial improvements of residential structures have the lowest floor (including basement) elevated to or above the base flood level; and
      (2)   New construction and substantial improvement of any commercial, industrial, or other nonresidential structure shall either have the lowest floor, including basement, elevated to the level of the base flood elevation, or, together with attendant utility and sanitary facilities shall:
         (a)   Be floodproofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water;
         (b)   Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; and
         (c)   Be certified by a registered professional engineer or architect that the standards of this section are satisfied. The certifications shall be provided to the official as set forth in § 153.25.
