§ 151.050 PROPRIETOR FILINGS.
   (A)   Proprietor to prepare and submit. Following final approval of the preliminary plat by the Village Council, the proprietor shall prepare in accordance with the Land Division Act, being M.C.L.A. §§ 560.101 through 560.293, a final plat and submit five copies thereof to the Village Clerk for approval by the Village Council. The plat shall contain the features of the approved preliminary plan and must be submitted to the Clerk within two years from the date of the approval by the Village Council of the preliminary plat or within two years from the date of the expiration of any extended period given in writing by the village; otherwise, the approval shall become null and void. The final plat shall comply with all the survey, mapping, and certification requirements set forth in the Land Division Act, being M.C.L.A. §§ 560.101 through 560.293. If the same shall have been submitted within the time provided, the Clerk shall place the final plat, and any accompanying documents, on the agenda of the Planning Commission for review at its next scheduled regular meeting.

   (B)   Proof of title. The proprietor shall submit, at the time of filing, the final plat, an abstract of title certified to date of the proprietor's certificate to establish recordable ownership interest, and any other information deemed necessary for the purpose of ascertaining whether the proper parties have signed the plat, or a policy of title insurance currently in force, covering all of the land including within the boundaries of the proposed subdivision. The Village Council, in lieu of an abstract of title, may accept an attorney’s opinion, in writing, based on the abstract of title as to ownership and marketability of title to the land.

   (C)   Receipts to be filed. At the time of filing of the final plat with the Clerk, the proprietor shall also file with the Clerk copies of any receipts showing that all fees, charges, or deposits required to be paid to the village have been paid.

   (D)   Improvements. The proprietor shall also file with the Clerk at the time of filing the final plat, final engineering construction plans for all improvements to be constructed in connection with the proposed plat in accordance with the standards of specifications required by the village or its ordinances. If the proprietor cannot complete the work within the period of time as required by the conditions of village approval for all public improvements, the proprietor shall be required to deposit with the village a certified check, performance bond, or other security that the village may require, to ensure full faith performance and compliance of the proprietor’s obligations under this chapter or the Land Division Act, being M.C.L.A. §§ 560.101 through 560.293.
