The Village Attorney may make application for an order authorizing the seizure of and forfeiture of personal property. The application shall be supported by a sworn affidavit setting forth probable cause for a forfeiture action. Upon a showing of probable cause to believe that the property is the instrumentality of a crime or the proceeds or substituted proceeds of a crime the court may issue an order authorizing the seizure and/or forfeiture of the property.
