§ 94.06 NOTICE AND ENFORCEMENT.
   (A)   The first time a violation occurs each growing season, the village shall notify the owner and occupant of any lot or parcel of ground found to be in violation of § 94.02 or § 94.03 of such violation, either by personal service or by regular first class mail and posting on the property.
      (1)   The owner shall have 10 days from the date of receipt of personal notice or of mailing of notice to remedy such unlawful conditions, which are hereby deemed to be a public nuisance.
      (2)   Only the current owner of record, as indicated on the city's tax and assessing records, shall be entitled to notice of violation.
      (3)   (a)   Failure to remedy the violation within the time shall be cause for the village to enter the property and remove the unlawful growth of grass, brush, scrub trees, poisonous vegetation and weeds without further notice; and
         (b)   In addition, the violation shall be a municipal civil infraction.
      (4)   Any expense incurred by the village in removing such unlawful growth shall be assessed as a lien on the property, and become a single lot assessment against the property upon which the growth existed.
      (5)   For additional violations in the same calendar year, notice shall be mailed by first class mail, giving the owner five days from the date of mailing to remedy the situation.
   (B)   Failure of the Village Manager, Code Enforcement Officer or other designated official to give such notice shall not, however, constitute a defense to any action to enforce the payment of any penalty provided for or debt created under this subchapter.
   (C)   The Village Clerk shall, during the month of April of each year, give notice of this subchapter by publishing the notice thereof in a newspaper of general circulation in the city, and by posting notice of this subchapter on the city's web site. Such publication shall constitute sufficient notice to those owners whose addresses are unknown and not reasonably ascertainable.
