(A) Definitions. For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
EXCAVATE. Moving any soil, sod, cement, or blacktop, or any other hard surface pavement, including also all sidewalks and curbs.
PERSON. Includes an individual, partnership, corporation, or association, including a person engaged as a contractor by a public agency, but PERSON does not mean a public agency.
POLES. All utility poles, owned by both private and public utilities.
PUBLIC AGENCY. A state, city, village, township, county, or any other governmental entity.
PUBLIC UTILITY. A natural gas company subject to the jurisdiction of the Federal Power Commission, or an electric, steam, gas, telephone, power, water, or pipeline company subject to the jurisdiction of the Public Service Commission as defined by M.C.L.A. § 460.701(d).

(B) Applies to; type of tools. This subchapter applies to any person or public agency using either non-powered handtools or power tools performing excavating or tunneling operations described herein.
