(A) Location. The sewer facility in the nature of a sanitary sewer extension to serve land described in Exhibit A, attached to the ordinance and made a part herein, to be constructed in the area commonly known as the Petredean/Swope Development, shall be known and described for the purpose of this section as the Phase I Petredean/Swope Development Sewer Extension.
(B) Intent. The charge provided for in this section is intended to constitute a contribution to the capital cost of construction of the Phase I Petredean/Swope Development Sewer Extension. The provisions herein are not intended to eliminate other charges provided for in this chapter or elsewhere in this code, except for the usual hook-up fee. The usual hook-up fee shall be waived because the construction includes tap-in lines to each of the lots located in the Phase I Petredean/Swope Development Sewer Extension.
(C) Contribution by users. The area set forth in Exhibit A of the ordinance codified herein is specially benefitted by the Phase I Petredean/Swope Development Sewer Extension, and the users therein should contribute to the capital cost of the extension. The users shall be responsible for paying five-sixths of the total cost.
(D) Cost of construction. The total estimated cost of the Phase I Petredean/Swope Development Sewer Extension is $23,000, and the capacity of the sewer facility is determined as ten taps, whereby the cost of each tap in 1994 dollars is $2,300.
(E) Capital cost contribution. A direct contribution to the capital cost of the Phase I Petredean/Swope Development Sewer Extension shall be made by the owners of each of the lots benefited thereby as follows: The charge provided for in this section is a direct contribution to the capital cost of the Phase I Petredean/Swope Development Sewer Extension. Except for the usual hook-up fee, this charge is not in lieu of, nor is it intended to eliminate, any other charges provided for in this chapter including, but not limited to, any consumption charge, service charge, user charge, debt service charge, or permit fee. Before any permit shall be issued to the lots within the Phase I Petredean/Swope Development Sewer Extension, the applicant shall pay to the village, in addition to other charges provided for in this chapter or other chapters, the sum of $1,917, in cash, for each lot, as a direct contribution to the cost of the improvement.
(F) Surplus funds. Any charges received in excess of the actual capital cost of the Phase I Petredean/Swope Development Sewer Extension shall be deposited into the Sewer Fund.
