Any dead, diseased or damaged tree or shrub on public property which may harbor serious insects or disease pests, or disease injurious to other trees, is hereby declared to be a nuisance. The City Council shall inspect or cause to be inspected any trees or shrubs in the City suspected or reported to be dead, diseased or damaged, and such trees and/or shrubs shall be subject to removal. The removal cost of the tree or shrub on public property shall be the City’s responsibility; however, the stump removal shall be the responsibility of the abutting property owner. All stumps of trees on public property shall be removed below the surface of the ground so that the top of the stump does not project above the surface of the ground. No burning or chemical means of stump removal is permissible. In addition to the above, the City shall have the right to cause the removal of any dead or diseased trees on private property within the City, when such trees constitute a hazard to a life, property, or harbor insects or disease which constitute a potential threat to other trees within the City. The City shall notify the property owner of the existence of such trees on said owner’s property. Removal shall be done by the property owner, at the owner’s expense, within 60 days after the date a written notice is served upon the property owner. Written notice will be deemed served if mailed by certified mail to the property owner’s last known mailing address. In the event of failure of the property owner to comply with the provisions of this section, the City shall have the authority to remove such trees and charge the cost of removal on the owner’s property tax.
