105.10   WASTE STORAGE CONTAINERS.
Every person owning, managing, operating, leasing or renting any premises, dwelling unit or any place where refuse accumulates shall provide and at all times maintain in good order and repair portable containers for refuse in accordance with the following:
1.   Container Specifications. Waste storage containers shall comply with the following specifications:
   A.   Solid Waste. Solid waste, not including recyclable materials, shall be placed in plastic bags and/or in tapered portable receptacles, 30 gallons or smaller, made of substantial metal or plastic construction provided with at least two handles and a tight-fitting cover. When filled, bags or containers shall weigh no more than 50 pounds per bag or container.
   B.   Recyclables. Recyclable materials shall be placed in separate containers for recyclables. Jars, bottles, aluminum products, tin cans and plastic jugs (co-mingled items) should be placed in the bottom of the recycling bin. Corrugated cardboard bundles should be placed on top, weighted down by bagged or bundled paper products. Paper products should not be mixed with co-mingled items.
   C.   Larger Quantities of Solid Waste. Persons disposing of large quantities of solid waste and recyclable materials shall use separate, City- or County-approved, marked and covered dumpsters for the separated solid waste and recyclable materials.
2.   Storage of Containers. Residential solid waste and recycling containers shall be stored upon the residential premises. Commercial solid waste containers shall be stored upon private property, unless the owner has been granted written permission from the City to use public property for such purposes. The storage site shall be well drained; fully accessible to collection equipment, public health personnel and fire inspection personnel. All owners of residential and commercial premises shall be responsible for proper storage of all garbage and yard waste to prevent materials from being blown or scattered around neighboring yards and streets.
3.   Location of Containers for Collection. Containers for the storage of solid waste awaiting collection shall be moved to the side of the alley or side of the curb on the designated day of collection as mutually agreed upon between the resident and the collector. Containers used for the collection of recycled materials shall be set at the same place as solid waste containers if collection is on the same day; however, if a separate day or time of collection is set for the collection of recycled materials, the containers shall be set at the side of the curb.
4.   Nonconforming Containers. Solid waste placed in containers which are not in compliance with the provisions of this section will not be collected.
