§ 106.99 PENALTY.
   (A)   Violation of any provision of this chapter shall, upon conviction thereof, be punishable by a fine of not less than $50 nor more than $500, or by imprisonment for not more than 60 days, or by both such fine and imprisonment in the discretion of the court. Each and every tree, as defined by this chapter, that is damaged, defaced, destroyed or removed in violation of this chapter, shall constitute a separate and distinct violation.
   (B)   An individual shall be in violation of this chapter if the trees are not relocated or replaced as specified by this chapter within 60 days of the granting of the tree removal permit; provided, however, if the trees are to be removed to facilitate construction, said relocation or replacement must be completed prior to issuance of a certificate of occupancy.
   (C)   An individual shall be in violation of this chapter if the trees to be relocated or replaced are not maintained in a healthy condition for a period of one year.
