§ 53.08 MUNICIPALLY-OWNED UTILITIES; RATES.
   (A)   The city shall have power to:
      (1)   Purchase, hire, construct, own, maintain, operate or lease local public utilities, including street railways, buses, boats, aircraft and all other kinds of transportation systems by land, air and water, electric light, telephone and telegraph systems, and works for supplying the city and its inhabitants with water, ice, gas for illuminating and heating purposes, and also all other manner of utilities.
      (2)   Sell the services of such utilities to consumers both within and without the limits of the city.

   (B)   The city shall have authority to establish, impose and enforce water rates, and rates and charges for gas, electricity and all other public utilities or other service or conveniences operated, rendered or furnished by the city or by any other person; all such regulations shall in no manner interfere with regulations prescribed by the State Public Service Commission, State Division of Hotels and Restaurants, or any other state governing board or commission duly organized and functioning by virtue of the laws of this state.
