(A) For purposes of this chapter, the following shall have the meaning ascribed to them by the Act:
(1) “Department.”
(2) “Grower.”
(3) “Industrial Hemp.”
(4) “Licensee.”
(5) “Marijuana.”
(6) “Marijuana Concentrate.”
(7) “Marijuana Establishment.”
(8) “Marijuana-Infused Product.”
(9) “Retailer.”
(10) “Processor.”
(11) “Safety Compliance Facility.”
(12) “Secure Transporter.”
(13) “State Operating License.”
(B) For the purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
AFFILIATE. Any person that controls, is controlled by, or is under common control with; is in a partnership or joint venture relationship with; or is a co-shareholder of a corporation, a co-member of a limited liability company, or a co-partner in a limited liability partnership with a licensee or applicant.
APPLICATION. An application for a permit under this chapter and includes supplemental documentation attached or required to be attached thereto; the person and/or corporate entity filing the application shall be known as the APPLICANT. If a corporate entity is the APPLICANT, the term includes any officer, director, or managerial employee of the entity.
COMMERCIAL MARIHUANA FACILITY, MARIHUANA FACILITY or FACILITY. An enterprise at a specific location at which a licensee is licensed to operate under the Act, including a marihuana grower, marihuana processor, marihuana retailer, marihuana secure transporter, marihuana safety compliance facility, and/or marihuana events.
DOOR-TO-DOOR. A point of measurement from the property line of a parcel to the property line of another parcel.
PARAPHERNALIA. Any equipment, product, or material of any kind that is designed for or used in growing, cultivating, producing, manufacturing, compounding, converting, storing, processing, preparing, transporting, injecting, smoking, ingesting, inhaling, or otherwise introducing into the human body, marihuana.
PERMIT. A current and valid permit for a commercial marihuana facility issued under this chapter. A PERMIT shall be granted to an applicant only for, and limited to “specific permitted premise(s)” and “specific permitted property(s)”.
PERMITTED HOLDER. The person that holds a current and valid permit under this chapter.
PERMITTED PREMISES. A particular building or buildings within which the permit holder will be authorized to conduct the facility’s activities.
PERMITTED PROPERTY. The real property comprised of a lot, parcel or other designated unit of real property upon which a permitted premises facility is situated.
PERSON. An individual, corporation, limited liability company, partnership, limited partnership, limited liability partnership, limited liability limited partnership, trust, other legal entity or any joint venture for a common purpose.
VILLAGE. The Village of Holly, a home rule village located in Oakland County, Michigan.
