(A) Any person in willful violation of a written promise to appear in the Municipal Court of the town given as provided in § 33.12(A) shall be guilty of a misdemeanor regardless of the disposition of the case wherein he or she is charged with the violation set forth in such notice and, upon conviction, shall be punished by a fine not to exceed $200.
(B) A written promise to appear in the Municipal Court of the town, under the provisions of § 33.12(A) may be complied with by an appearance by counsel.
