The judgment, in the cases of conviction in all actions before the Municipal Court of the town, shall be that the state, for the use and benefit of the town, recover of the defendant the fines assessed, all costs of court and the state tax levied thereon, and that the defendant remain in custody of the Police Department of said town until such fine is paid or otherwise discharged by law; and that execution issue to collect the same.
