For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APARTMENT. A room or suite of rooms in a building which are rented, leased, let or hired out to be occupied as a residence by a single family.
BUILDING. Any structure having a roof supported by walls on four sides.
DWELLING. A building arranged, designed or built to be occupied as a residence by a single family.
MULTI-FAMILY. Any group of people not comprising a single family as hereinafter defined.
OWNER. Any person (other than a lien holder not in possession) having title to or any interest in any property, real, personal or mixed. Proof that the title to any property is shown in any person by the public records of the town, the county or the state, shall be prima facie proof that such person is the OWNER of such property in any action tried in the Municipal Court of the town or any other court of competent jurisdiction but such prima facie proof may be rebutted by any party against whom such proof is offered in any such action.
PERMITTED USE. A use allowed in one or more of the various districts without the necessity of obtaining a specific use permit.
PERSON. Any natural person, partnership, corporation or other artificial entity recognized as existing as an entity separate and apart from the owners thereof by the laws of the state, as well as the government and any political subdivision or agency of the United States, the State of Texas, any other state comprising the United States of America or any foreign state or nation.
PIERS AND DOCKS. Any structure extending into public waters.
SINGLE FAMILY. Any number of people related within at least the second degree of consanguinity or affinity but not more than six persons not so related.
STRUCTURE. Anything constructed, the use of which requires permanent location on the ground or attachment to something having a permanent location on the ground.
STRUCTURAL ALTERATIONS. Any change in the structural member of a building, such as walls, columns, beams or girders.
VARIANCE. A legal modification of any district provisions not relating to use.
