§ 159.068 INSPECTION AND CERTIFICATION.
   (A)   Regular inspections; fee. The local government engineer, or other knowledgeable official, as specified by the local government, shall regularly inspect for defects in construction of required improvements and ensure their satisfactory completion. The applicant shall pay to the local government an inspection fee as identified in Appendix C, at the end of this chapter. Such fee shall be due at the time of record plat approval. Upon completion of these improvements, the local government engineer shall file a statement either certifying that the improvements have been completed in specific manner or listing the defects in those improvements.
   (B)   Conveyance of improvements. Upon completion of the improvements, the subdivider shall file with the local government an agreement to convey said improvements to the local government. Such statement shall stipulate the following:
      (1)   All required improvements are complete;
      (2)   These improvements are in compliance with the minimum standards and specifications adopted by the local government for their construction;
      (3)   The subdivider knows of no defects from any cause in these improvements; and
      (4)   These improvements are free and clear of any materials or mechanic’s lien.
