§ 32.030 POWERS RELATIVE TO EXCEPTIONS.
   (A)   The Board shall have the power to hear and decide special exceptions to the terms of this subchapter upon which the Board is required to pass under this subchapter.
   (B)   Upon appeal, the Board is empowered to permit the following exceptions:
      (1)   To permit the extension of a district where the boundary line of a district divides a lot in single ownership as shown of record;
      (2)   To interpret the provisions of this subchapter where the street layout actually on the ground varies from the street layout as shown on the map fixing the several districts, which map is on file in the office of the City Clerk;
      (3)   To grant exceptions to the off-street parking requirements set forth in this code when it is determined that the size and shape of the lot to be built on is such that off-street parking provisions could not be complied with, and that the proposed use will not create undue traffic congestion in the adjacent streets; and
      (4)   To grant exceptions to the setback and area requirements herein established where the slope of the land on 20% or more of the lot to be built on exceeds 10% where such slope interferes with the reasonable development of the property for the uses permitted in the district in which the lot is located; provided, however, that whenever exceptions are granted to setback or to area requirements, new setback and area requirements for the lot or lots covered by the exception shall be specifically set forth in a manner that will carry out the purpose and intent of these regulations.
