§ 132.04 UNNECESSARY NOISE.
   (A)   Loud noise or music; amplified sound. It is unlawful for any person to disturb the peace and quietude of any part of the city by operating, having operated, or permitting to be operated, any contrivance, whether electric or not, with or without a loudspeaker, in such a manner as to emit loud music, noise or words. This section shall not prohibit religious bodies from playing chimes, bells, carillons or other religious music.
   (B)   Unnecessary noises enumerated. It is unlawful for any person to create any loud or unnecessary noises of such character, intensity or duration as to be detrimental, or disturbing to the peace, lives or health of any individual. The following acts, among others, are determined to be loud, disturbing and unnecessary noises in violation of this section, which enumerations shall not be deemed to be exclusive, namely:
      (1)   Horns, signal devices. The sounding of a horn or signal device on any automobile, motorcycle, bus or other vehicle while not in motion, except as a danger signal if another vehicle is approaching apparently out of control; or, if in motion, only as a danger signal after, or as brakes are being applied and declaration of the vehicle is intended; or the creation by means of any such signal devices of any unreasonably loud or harsh sound, and the sounding of any such devices for any unreasonable or unnecessary period of time;
      (2)   Radio, musical instrument. Playing of any radio, phonograph or any other musical instrument in such manner, or in such volume, particularly during the hours between 11:00 p.m., and 7:00 a.m., as to annoy or disturb the quiet, comfort or repose of the persons in any dwelling, hotel or other type of residence;
      (3)   Animals; barking, other noises. To own, keep, have in his or her possession, or harbor, any animal which by frequent, or habitual howling, yelping, barking or otherwise shall cause serious annoyance to persons or to the neighborhood;
      (4)   Noisy vehicles. The use of any automobile, motorcycle or vehicle so out of repair, so loaded, or operated in such a manner as to create a loud or unnecessary grating, grinding, rattling or other noise;
      (5)   Exhaust. The discharge into the open air of the exhaust of any steam engine, stationary internal combustion engine, motor vehicle, except through a muffler or other devices, which will effectively prevent loud or explosive noises therefrom;
      (6)   Compressed air devices. The use of any mechanical devices operated by compressed air, unless the noise created thereby is effectively muffled and reduced;
      (7)   Near schools, hospitals. The creation of any excessive noises on any street adjacent to any school, institutions of learning, or court, while the same is in session, or adjacent to any hospital, which unreasonably interferes with the working of such institution, provided conspicuous signs are displayed on such streets indicating that the same is a school, hospital or court street;
      (8)   Loading or unloading vehicles. The creation of any loud or excessive noises in connection with the loading or unloading of any vehicle, or the opening and distribution of any bales, boxes, crates and containers;
      (9)   Peddlers shouting. The shouting and crying of peddlers, hawkers and vendors which disturb the quiet and peace of the neighborhood;
      (10)   Handling trash containers. To make unnecessary noises in the handling of ashes, trash and garbage cans either in loading or unloading, and whether full or empty;
      (11)   Transporting iron, metals. The transporting of rails, pillars and columns of iron, steel, casing or tubing, or other metals over and along the streets of the city, upon carts, drays, cars, or in any other manner, so loaded as to cause loud noises to disturb the peace and quiet; and
      (12)   Automatic piano, musical instruments. The use or operation of any automatic, or electrical piano, phonograph, gramophone, radio, victrola, loudspeakers, or any musical instrument, or any instrument of sound producing, or sound amplifying, or like character, so loudly as to disturb persons in the vicinity thereof, or in such a manner as to render the same a public nuisance.
