§ 31.64 CONFIDENTIALITY.
   The city will treat all tests and all information related to such tests, as confidential materials. All records relating to drug testing will be kept separated from personnel records. The records are the property of the city but will be made available to the affected applicant or employee for inspection and copying upon request and will also be available for review by the Review Officer. Except as set forth below, the records will not be released to any person other than the applicant or the employee without that person’s express written permission. However, the city may release the records:
   (A)   To comply with a valid judicial or administrative order;
   (B)   As admissible evidence in a case or proceeding before a court of record or administrative agency if the employee or the city is named as a party in the case or proceeding; or
   (C)   To employees or agents of the city who need access to the records in connection with the administration of this subchapter and the Oklahoma Standards for Workplace Drug and Alcohol Testing Act.
