§ 98.05 PROCEDURE FOR REVOKING PERMIT LICENSE.
   (A)   Application for revocation; hearing. If a permit license holder fails to comply with the above requirements within the time specified, the animal control officer shall file with the City Clerk an application to revoke the permit license. A copy of the application shall be served on the permit license holder either in person or posted in a conspicuous place on the premises wherein the animals or poultry are confined. The application shall ask the City Clerk to enter a revocation of the permit license seven days after the date of filing the application to revoke and the City Clerk shall enter the revocation as applied for unless within the seven days set out in the application for revocation the permit license holder files with the City Clerk a letter stating that he or she intends to appear before the municipal judge to show cause why his or her permit license should not be revoked. If the letter of intention to show cause is filed, the permit license holder shall forthwith proceed to the municipal judge and ask the municipal judge to set a time certain for the hearing convenient to the animal control officer and Chief of Police. After such hearing which shall be conducted as a municipal court trial, the judge shall determine whether or not the requirements imposed by the officers are reasonable and if the permit license holder has complied with the same.
   (B)   Decision Of Municipal Judge; court costs. If the findings show that the permit should be revoked, the Municipal Judge shall give an order to the City Clerk ordering him or her to revoke the permit license forthwith. If the findings are in favor of the permit license holder, the municipal judge shall order the City Clerk not to revoke the permit license. In no event shall the municipal judge hear the appeal unless first the permit license holder deposits with the court the sum of $45 to represent court costs in the case and will not be refunded in any event.
