§ 98.03 PERMIT LICENSE FEES AND REQUIREMENTS.
   The City Clerk is authorized to issue to any person, family, firm or corporation the following permits after the person, family, firm or corporation has paid the following designated fees and by written application has shown that he or she has fully met all other requirements of this chapter.
   (A)   Livestock.
      (1)   Permit license fee for the keeping, maintaining and having horses, mules, donkeys, cattle, goats or sheep is $5 total annually.
      (2)   In no event shall the permit be issued unless the application therefor states that applicant’s suitable enclosure or pen measures at least 500 square feet for each animal unit the applicant intends to keep or maintain under the license permit, and states that the exterior limit of applicant’s suitable pen or enclosure is at least 50 feet from the exterior limits of any dwelling resided in by anyone other than the applicant unless all the adult residents whose dwellings are nearer than 50 feet, waives in writing his, her or their objections, if any, to the issuance of the permit license. The applicant is responsible for procuring waivers of objections in order to support his or her application.
   (B)   Potbellied pigs.
      (1)   Permit license fee for the keeping, maintaining and having potbellied pigs is $5 annually.
      (2)   In no event shall the permit be issued unless the Police Chief or animal control officer inspects the applicant’s location in which he or she intends to keep the potbellied pigs and certifies in writing to the City Clerk that the location is suitable and is not likely to become unsanitary; and in addition, applicant must, before permit is granted, present with his or her application signed waivers of objections to the issuance of the permit license from all adult residents of the city residing within 100 yards of the exterior limits of the area in which the potbellied pigs are to be confined. The width of streets and alleys shall not be considered in determining the above measure of distance. The applicant is responsible for procuring waivers of objections in order to support his or her application.
   (C)   Poultry. Permit license fee for the keeping, maintaining and having poultry is $5 annually, subject to the following.
      (1)   (a)   In no event shall the permit be granted unless the applicant shows that the exterior lines of the house or pen in which the poultry are to be confined are at least 100 feet to the exterior limits of any dwelling resided in by anyone other than the applicant unless all of the adult residents whose dwellings are nearer than 100 feet to the enclosure waives in writing his or her objections, if any, to the issuance of the permit license.
         (b)   The applicant is responsible for procuring waivers of objections in order to support his or her application.
      (2)   No poultry permit licenses shall be issued or be valid if the applicant is requesting to keep within the city a combination total of more than 12 rabbits, chickens and other poultry, or any combination thereof.
   (D)   Permit license expiration.
      (1)   Each of such permit licenses expires on January 1 of each year unless sooner revoked.
      (2)   Keepers of poultry or animals must thereafter and on each successive year secure a new permit license to retain the privileges granted in the same manner and on the same conditions and applications as the permit license originally granted, and the new permit shall be good for each calendar year or fraction thereof, that they remain in force and effect.
      (3)   Waivers of objections from neighbors described above may be carried over to a successive year’s application unless a neighbor revokes his or her waiver of objection or submits an objection in writing to the city.
